Materia Libra Terms of Website Use

Welcome to the Materia Libra website at: https://www.materialibra.com (hereinafter: the “Website”).

The Website constitutes an e-commerce platform for the purchase of fashion jewelry and fashion accessories designed and manufactured by Materia Libra, including wooden jewelry, metal jewelry, and other materials (hereinafter: the “Products”), by users of the Website (hereinafter: the “User”).

Use of the Website, including the purchase of Products through it, is subject to the terms detailed in these Terms and Conditions (hereinafter: the “Terms”).

Use of the Website constitutes full agreement to these Terms and to the Website’s Privacy Policy.

1. Introduction and Acceptance of Terms

1.2 If you do not agree to these Terms, you are requested to refrain from using the Website.
1.3 These Terms are written in the masculine form for convenience only and apply to all genders.
1.4 These Terms constitute a binding agreement between the User and the Website management.
1.5 The Website management may update these Terms from time to time at its sole discretion. An updated version will be published on the Website and will enter into force upon publication.

Upon termination, your right to use the Website will immediately cease, and you will remain responsible for any obligations incurred prior to termination.

3. Nature of the Website and Products

3.1 The Website displays and sells uniquely designed fashion jewelry.
3.2 The Products may include wood, metals (brass, aluminum, stainless steel), natural and synthetic stones, glass, ceramic, various coatings, and
ther materials.
3.3 Images on the Website are for illustration purposes only. Slight differences in color, texture, or size may occur.
3.4 Some images may be generated using AI.
3.5 Limited editions or unique items may not be permanently in stock.
3.6 The Company makes efforts to present accurate information; however, slight variations between images and actual Products may occur, including color or texture differences due to photography or screen display.
3.7 Nothing herein shall derogate from consumer rights in the event of defect or non-conformity as defined by law.

4. Orders and Purchases

4.1 Displaying a Product on the Website does not constitute a binding offer.
4.2 Placing an order is subject to providing complete and accurate details.
4.3 Prices include VAT as required by law, unless otherwise stated.
4.4 The Website management may refuse or cancel an order in the event of:

• Pricing errors
• Out-of-stock items
• Suspected unlawful use
• Technical malfunction

4.5 Payment may be made via:

The transaction will be confirmed only after approval by the credit card company/payment processor.

4.6 An order confirmation email constitutes confirmation of receipt only. A binding contract is formed upon dispatch of the Product to the customer.
4.7 Shipping costs will be displayed separately at checkout.
4.8 The Company may update prices; however, the binding price is the one confirmed at the time of order.

5. Delivery and Shipping

5.1 Deliveries will be carried out via: Israel Post.
5.2 Delivery times are estimates and depend on external factors.
5.3 The Website management shall not be liable for delays beyond its control (force majeure, strikes, courier delays, etc.).
5.4 The User is responsible for providing an accurate address.
5.5 International shipments will be subject to the cost and delivery time specified at checkout.

6. Cancellation and Returns

6.1 Cancellation shall be carried out in accordance with the Israeli Consumer Protection Law, 1981, and its regulations.
6.2 A transaction may be canceled within 14 days from receipt of the Product (or from receipt of transaction details, whichever is later).

6.4 In lawful cancellation cases, payment will be refunded within 14 days, less cancellation fees as permitted by law (5% or 100 ILS, whichever is lower).
6.5 A Product may be returned only if:

• It has not been used
• It is returned in its original packaging
• It has not been damaged

6.6 Custom-made Products (e.g., personalized items or items restricted for hygiene reasons) cannot be canceled, subject to applicable law.
6.7 Return shipping costs shall be borne by the customer unless the Product is defective.

7. Warranty

7.1 The Website undertakes to provide quality, defect-free Products.
7.2 The User must inspect the Product upon receipt and report any defect within 14 days.
7.3 The warranty does not apply in cases of:

• Unreasonable use
• Exposure to chemicals
• Natural wear and tear
• Damage caused by impact or improper use

8. Intellectual Property

All rights in the Website, including:

• Website design
• Materia Libra logo
• Images
• Texts
• Unique jewelry designs

are the exclusive property of the Website management.
No copying, distribution, reproduction, or commercial use is permitted without prior written consent.

Exclusive jurisdiction shall lie with the competent courts in the district of Tel Aviv.
